This Revision is directed against the Order dated 11-04-2017, passed by the Ld. District Forum, Darjeeling in CC/85/2016.

The short case of the Revisionists is that, on notice, they appeared before the Ld. District Forum through Ld. Advocate on 19-10-2016 and sought for time for filing WV.  Although necessary papers were handed over to the concerned Ld. Advocate, he failed to file the same on the next day on 05-12-2016 and therefore, the matter was fixed ex parte. Although the Revisionists prayed for vacating the said ex parte order subsequently, vide impugned order such prayer was rejected by the Ld. District Forum; hence, this Revision.

Despite service of notice upon the Respondents, they did not turn up.  Therefore, at the time of hearing, only the Ld. Advocate for the Revisionists was heard.

Considering all aspects, for ends of justice, Revisionists are allowed to submit their WV.  Fix 18-10-2019 for appearance of the parties before the Ld. District Forum and submission of WV by the Revisionists invariably. The impugned order is hereby set aside subject to strict compliance of this order.

Revision, accordingly, stands allowed.
