                                    Heard.

                        2.         By filing this appeal, the appellant / complainant has challenged the order dated 25.5.2012 passed by the District Consumer Disputes Redressal Forum, Narsinghpur (for short the “Forum”) in CC No.91/2010.

                        3.         The Forum vide impugned order has dismissed the complaint on the ground that the transaction in question is a commercial transaction and as such the complainant will

not come under the ambit of term “consumer” as provided under the Consumer Protection Act, 1986. 

 

4.         We find that thereafter in the appeal, the complainant had filed an application seeking amendment in the original complaint so as to incorporate the plea that the complainant is doing the business for his livelihood.  However, the said application was rejected by the Commission vide order dated 4.8.2015. 

 

5.         In the circumstances, we are of the view that the complaint being regarding the commercial transaction the Forum has committed no error in dismissing the complaint holding it to be not maintainable.

                       

6.         The appeal is dismissed.
