The record is put up on the prayer of the complainant for admission hearing.

Perused the petition of complaint supported by affidavit and the relevant documents thereto.

Heard the Ld. Advocate for the complainant.

Though the case is admissible from the point of territorial and pecuniary jurisdiction and also the period of limitation but the complainant has no prima facie case to proceed against.

The complainant has a Bank Account No. being 32965526541 with S.B.I. Beliatore Branch, Bankura and on 23-01-2018 a sum of Rs.19,990/- was deposited in the said Account by some unknown person and thereafter Rs.20,000/- was withdrawn by  a stranger through S.B.I. Sangramgarh Branch, U.P. and on query the complainant came to know from the U.P. Bank Authority that an F.I.R. has been lodged being Sangramgarh P.S. case No.28 of 2018, dated: 24-08-2018 u/s 66 (D) of Information and Technology Act, 2000 over the said deposited transaction and a case is also pending before the Hon’ble Consumer Commission involving the said fact.

The Account of the complainant being suspected and is under investigation the same has been withheld by the concerned Bank Authority. 

It is well settled that the Commission will not go into any matter involving crime aspect and as such the instant case is not maintainable before this Commission.

Hence it is ordered………

That the case is dismissed as being not admissible for reasons stated above.

Let a copy of this order be given to parties free of cost.
