Final Order / Judgement

The Advocate for the petition so also Advocate for OP is present. Heard the argument of the I.A. After scrutiny of documents it reveals that the petitioner has paid the EMIS up to March 2019 for which an interim order was passed by this learned forum with a direction the OP No.1 & 2 not to sale the alleged vehicle. During the course of hearing the Ld Advocate for the petitioner submitted to release the vehicle. Further he submits that the petitioner is ready to pay the outstanding EMIs in installment basis or else the petitioner shall be highly prejudiced and shall sustain irreparable financial loss. The Adv for the OP No. 1 & 2 vehemently opposed the submission of the Ld Advocate for the petitioner and submitted that the petitioner is a defaulter in paying the EMIs, as such huge amount is outstanding against the petitioner. After careful consideration and perusal of the materials available on record it reveals that the petitioner has paid the EMIs up to March 2019, Which has also been received by the Ops

On the above discussion we hold that for the interest of justice it would be just and proper to release the vehicle in favour of the petitioner. Hence it is ordered .

ORDER

The OP No. 1 & 2 are directed to release the vehicle of the petitioner bearing reg no – OD 25 D 0899 after receiving Rs 2, 62, 000/- from the petitioner forth with. Further the petitioner is directed to pay the EMIs regularly to the Ops and also directed to pay the outstanding dues in installment basis within 6 (Six) months. Accordingly this Misc Case is disposed of.
