ORDER

BY SRI.H.R.SRINIVAS, PRESIDENT.

1.     During the pendency of the complaint after recording the evidence, complainant by filing a memo stated that the amount claimed in the complaint has been paid and he is to be paid the compensation and the litigation expenses. Op has also filed a memo stating that they have settled the disputed amount.

2.     The complainant has claimed Rs.10 lakhs towards wrongful loss caused by Op and for mental agony and financial loss. He has also prayed for granting cost of the proceeding and other reliefs as the commission deems fit.

3.     It is the cardinal principles of granting compensation that it should be just, proper and reasonable and it should not be exorbitant and lottery to the complainant.  Having this in mind and upon careful consideration of the rival claim, we are of the opinion that if a sum of Rs.25,000/- towards damages for causing mental agony and hardship to the complainant by OP and the complainant suffering the same if awarded would be just, proper and reasonable. Further the act of the OP made the complainant to approach this commission by engaging the advocate to file this complaint and to conduct the case, for which OP to pay some amount. Hence, we order OP to pay litigation expenses of Rs.10,000/- and pass the following:-

 

ORDER

1. OP i.e. State Bank of India represented by its manager is hereby directed to pay  sum of Rs.25,000/- towards damages for causing mental agony and hardship to the complainant by OP and further Rs.10,000/- towards litigation expenses Within three months failing the same shall carry interest at 10% per annum from the filing of this complaint i.e. 05.10.2021 till payment of the entire amount.

2. Send a copy of this order to both parties free of cost.
