Both parties file hazira through Ld. Advocate prayer for adjournment on behalf of the Complt. Hence considered by rejected.

Heard the petition filed by the O.P on the maintainability issue of the case with objection of the Complt. Though it is not a case of removal of material defects as pointed out by the Ld. Advocate for the O.P but for ends of justice the case stands withdrawn with liberty to file a fresh Complaint on the same cause of action if not by barred by law.
