     Advocate Mr. S.D. Ingole is present for appellant. Mr. S.P. Gajbhiye, the Branch Manager of Union Bank of India, Wardhaman Nagar, Nagpur is also present as representative of the appellant. Advocate Mr. J.P. Kothari is present for respondent. The aforesaid advocates under their joint signature and signature of aforesaid representative of the appellant filed a  pursis  and made submission as stated  in that pursis. Advocates of appellant and respondent submitted that  both the parties have arrived at settlement and  the appeal may be disposed of as per submission made in the said joint pursis. They also submitted that the parties have accordingly authorized the respective advocates to settle the dispute as per the said pursis. Hence the said joint pursis is taken on record.

     It is stated in the said pursis by both the parties that the appellant’s advocate will provide the demand draft of Rs.5,16,645/- with interest   at the rate of 9.25 percent per annum with effect from 2/7/2012 till final payment to the respondent as per circular  dated 21/01/2012 bearing  number 9189. Thus, the impugned order is modified and substituted to the aforesaid effect as mentioned in the joint pursis. The appeal is disposed of in terms of the above submission made in the said joint pursis. No order as to cost in appeal. Copy of the order be furnished to both the parties, free of cost.
