Heard learned counsel for the petuitioner.

Learned counsel for the petitioner seeks time to file substitution petition. Earlier, he has also taken time to file th esubstitution petition. He has not filed substistution petition.

This is a matter of 2005. we do not find the reason to give time. Hence the prayer is rejected. Since the substitution petition is not filed, appeal abates.
