Pardhuman Bhullar vs. OIC.

     Smt. Aruna Sharma, Adv. for opponent.

 

                 The petitioner while filing the execution petition, alleged, the opponent is still liable to pay Rs.25933/-.

                 Heard.

                 Indisputably, in terms of order dated 29.8.2023 passed by this Commission in CC No.454 of 2022, the opponent made payment of Rs.716000/- to the petitioner on 02.02.2024. As per order dated 29.8.2023, the opponent was required to make payment of award amount including punitive damages to the complainant (petitioner) within the period of two months from the date, he submits KYC document with the opponent No.1+ certificate from the RTA office with regard to cancellation of Registration of car bearing No.HR70B-8786 and in default of it, the opponent No.1 was liable to pay simple interest @8% p.a. from the date or order till actual payment. The petitioner performed his part of obligation on 27.12.2023 only, fact is reflected from letter of the same day addressed by him to the opponent, which is not disputed and the letter of undertaking furnished by him on 19.12.2023 and the payment of award amount has been deposited in the Commission to pay to the petitioner on 2.2.2024. The opponent did the compliance of order dated 29.8.2023 in time and made the payment within the stipulated period from the date of performance of his part of obligation by the complainant/petitioner and in the execution petition, the petitioner wrongly claimed interest from the date of order.  No amount is outstanding against the opponent. Prayer of the petitioner to recover the amount of Rs.25933/- is declined. Record of the execution petition is hereby ordered to be consigned to the records, treating it, fully satisfied.
