While dismissing the Complaint filed by the Petitioner, praying for compensation of Rs.3,50,000/- with interest @ 24% per annum, both the Fora below have recorded a concurrent finding of fact that there was no deficiency in rendering service on the part of the Railways. The allegation that when the Petitioner/Complainant had illegally boarded the cabin of the Guard, he was abused and thrown out of the said cabin, has not found favour with the lower Fora.

The said finding is a pure finding of fact and we do not find any jurisdictional error in arriving at the said finding by the lower Fora.  The Revision Petition is dismissed accordingly, with liberty to the petitioner to take recourse to any other remedy for redressal of his grievance as may be available to him in accordance with law.
