This is an application for review filed against order dated 29.4.2013. We have gone through the application and have perused the record. Petitioner for the first time by way of present application is seeking recourse to provision of Section 14 of the TRAI Act, 1997. The consumer complaint filed by the petitioner/complainant was dismissed by the District Forum and appeal filed by the petitioner challenging the order of the District Forum was also dismissed by the State Commission. Thereafter, petitioner filed revision petition before this Commission which was also dismissed vide order dated 29.4.2013, of which review is being sought. It would be pertinent to point out that petitioner has challenged the order dated 29.4.2013 passed by this Commission before Hon’ble Supreme Court by way of Special Leave Petition. Later on, petitioner withdrew the Special Leave Petition with liberty to file review petition before this Commission. The petitioner was non-suited by all the consumer fora, in view of decision of the Hon’ble Apex Court in General Manager, Telecom Vs. M. Krishnan and Anr. (2009) SCC 481. All the consumer fora are bound by the decision of the Apex Court. In view of the above decision of the Apex Court only, this Commission dismissed the revision petition. Under these circumstances, we do not find any ground to review the order dated 29.4.2013, passed by this Commission. Accordingly, application for review filed by the petitioner stands dismissed.
