District Forum and the State Commission have dismissed the complaint filed by the petitioner/complainant at the preliminary stage without issuing any notice to the respondents on the ground that the complaints regarding telephone bills were not maintainable in view of the law laid down by the Supreme Court in General Manager, Telecom VS. M.Krishnan & Anr. – (2009)8 SCC 481. 

Petitioner, who is appearing in person, contends that the judgment in M.Krishnan’s case (supra) was not applicable to the facts of the present case, as Section 7B does not refer to the disputes regarding billing.  We are unable to accept the contention of the counsel for the petitioner because in M.Krishnan’s case (supra) Supreme Court while dealing with the case of billing held that in view of the provisions of Section 7B of the Telegraph Act, no complaints were maintainable and the dispute between the parties could be resolved through arbitration only.

We are bound by the law laid down by the Supreme Court and respectfully following the same, revision petition is dismissed with no order as to costs.
