ORDER
We will dispose off both the complaint cases by this order as the facts of these cases are similar and identical.
The gist of the complaint in both the matters is that the complainant on 23/11/2013 boarded the flight AI 048 operated by the OP from Delhi to Trivandrum. After about 15 minutes of take off the complainant started feeling uncomfortable due to high hot temperature of the cabin instead of cool atmosphere which is usually maintained in the flights. The complainant complained the same to the cabin attendant Sh. Tarun, who assured to remedy. After about half an hour of making the complaint no improvement in this situation was noticed and the complainant continued to feel uneasiness alleging that the cabin temperature rose up. Again the complainant was made. On landing at Cochin Airport, a team of engineers came and inspected the flight . It is alleged that the team was not able to diagnose the problem, however, assured that the said problem would not occur again. The complainant also informed the cabin incharge who refused to entertain the complaint. Due to such hot atmosphere, the complainant suffered from severe and acute migraine problem. The complainant alleged that the flight attendant Sh. Tarun and the cabin in- charge Ms.Virk were rude.
After notice the OP filed written statement denying all the allegations made against it. It is stated on behalf of the OP that the temperature indications of different zones of the cabin were checked and were normal and OP’s staff Head taken due care of the complaint made by the complainant regarding hot temperature.
It is also stated that the altitude at which the aircraft flies the density of air is very low and as such to keep the cabin pressure comfortable all safety measures are duly observed. It is also stated that none accept the complainant made any complaint in this regard. The complainant had performed the entire journey without protest or objection in board or after landing. It is also stated that comfortable atmosphere and pressure at high attitude is mandatory in the flight aircrafts, otherwise it can endangered the life of the travelers and therefore, all precautionary measures, the air conditioning system were reset and checked and the temperature indications were found normal.
Both the parties have filed their respective evidence by way of affidavit and also filed written arguments. Both the parties also addressed oral arguments.
We have considered the material placed before us and the submissions made by the parties with relevant provisions of law.
The perusal of the record before us does not show any document/ copy of complaint made by the complainant during in board or thereafter except the legal notice dated 16/12/2013 sent to the OP. The date of flight is 23/11/2013 and the legal notice was sent after 20 days of the journey. Further, there is no substantiating document which points out the alleged deficiency on the part of OP regarding the cabin temperature. Even the complainant himself has not stated that such a complaint was made by other co-passenger.
It is not convincing that an aircraft flying at high altitude was made to fly with hot cabin temperature as alleged by complainant.
In view of the above, we do not find merit in the complaints and are accordingly dismissed with no orders as to cost.
Copy of the order may be forwarded to the parties to the case free of cost as statutorily required.
