The brief facts of alleged deficiency are that the complainant travelled from Delhi to Ahmadabad on 13.9.2014 at 8 p.m. via OP airlines. He was served biscuits and tea in place of promised dinner. Tickets annexed. The complainant’s wife was on medication which she could not take as no dinner was served and all place for dinner was closed by the time they reached their destination.
OP in its version has admitted that complainant travelled with their airlines on the aforementioned date and was served tea & biscuits as per policy. OP submits that ticket was purchased online through Yatra.com where the passengers are required to provide the meal preference as Veg./Non-veg./Fair meals. It is also alleged that complainant had himself mentioned Dinner as meal preference.
We have considered the arguments and pleadings of both parties. Complainant has filed copy of ticket which clearly shows:
Departure 20:00
Arrival 21:25
Meal Dinner
It is difficult to believe that for serving tea and biscuits, veg/non-veg options are required taking into consideration the timing of the flight meal is promised in the air ticket and “Dinner” typed by passenger has been accepted by OP. The liability to provide dinner lies on OP which it cannot eschew under any pretext.
We, therefore, hold OP guilty of deficiency in not providing the meal promised on ticket and direct it to pay Rs.5,000/- as compensation for harassment and mental agony. We also award Rs.5,000/- towards litigation expenses.
The order shall be complied with within 30 days of the receipt of the copy of the order; otherwise action can be taken under Section 25 / 27 of the Consumer Protection Act.
File be consigned to record room.
Copy of the order be sent to the parties free
of cost.
