Complainant has filed this complaint before this Forum under Section 12 of the Consumer Protection Act 1986 (the Act) against Against Air India Corporation Ltd. On 19.09.2012, the complainant booked two confirmed Air tickets for self and her minor daughter’s through the Travel Portal- “Make My Trip” vide ID No. NF2202121929243. She had a journey from Delhi to Kolkata by respondent’s flight no. AI-401 and onward from Kolkata to Dimapur by AI-709. They reached at Airport on 09.12.2012 at 05:30 a.m. almost one and half hour prior to the departure of the schedule flight from Delhi to Kolkata. The complainant contacted the booking clerk for their boarding passes but the booking clerk referred to the Manager who informed the complainant along with eight other passengers that the flight is over-booked and were being taken to another flight. Complainant had to go to attend her niece marriage on 10.12.2012, left no other option but to accept the request of the said Manager.
10. Both the parties filed their respective evidence and also the written arguments. Oral arguments were also addressed from both sides. We have gone through the material placed before us. The undisputed facts are that the complainant booked flight no. AI-709 for Dimapur to be routed through Kolkata. The OP denied the boarding as due over booking of the tickets. Further, the alternate arrangements were made through the flight bearing no. AI9751 which was to route through Guwahati for Dimapur with connecting flight. The complainant reached Guwahati and after sometime it was informed that the connecting flight Guwahati to Dimapur had been cancelled . The ticket fare from Guwahati to Dimapur was refunded to the complainant. The issue for adjudication is that the OP neither same any alternate arrangements even after denying the boarding on delay flight no. AI-401 and rerouting the visit from Guwahati where the flight no. AI-9751 from Guwahati to Dimapur was cancelled. Not only this, no intimation about the cancel of flight was conveyed to the complainant beforehand. The complainant relied on the copy of local newspaper “Nagaland Post” filed wherein It is mentioned that due to operational reason Air India has cancelled the flight AI9751 (DMU_IMF) on Decembe, 2009. The newspaper is dated 09.12.2012.
The OP shall be complied within 30 days after the receipt of this order. Copy of the order may be forwarded to the parties to the case free of cost as statutorily required. The orders be uploaded on www.confonet.nic.in. File be consigned to record room.
