Complainant has filed the present complaint under Section 12 of the Consumer Protection Act, 1986 against OPs seeking directions to OPs to credit the amount of Rs.25,875/-wrongly debited by them alongwith interest and for further directing OPs to pay Rs.50,000/- as compensation for deficiency in service and harassment alongwith litigation expenses of Rs.11,000/-.
2 Briefly stated, the case of the complainant is that complainant firm has cash credit account bearing no.2250048430000092 in the name of complainant no.2 and it always fulfils all the conditions and formalities regarding said account with OPs. It is submitted that Ops illegally and unlawfully debited Rs.25,875/- from cash credit account of complainant firm on 30.04.2017 without their consent for the period of 2017-2018 though complainant never applied for said limit in the year 2017-2018. It is further submitted that said cash credit limit of complainant firm has been completed with OPs on 30.07.2017 and even complainant closed the same on 4.08.2017. Complainant approached OPs and requested them to credit the amount of Rs.25,875/-illegally debited by them from the account of complainant and on hearing his complaint, Ops assured to refund the same, but thereafter, despite several visits and repeated request, they kept lingering on the matter on one pretext or the other and did not pay heed to his genuine requests. All this act and conduct of OPs amounts to deficiency in service and has caused harassment and mental agony to him. He has prayed for directing OPs to pay compensation alongwith litigation expenses besides the main relief. Hence, the complaint.

3 The counsel for complainant was heard with regard to admission of the complaint and vide order dated 25.03.2019, complaint was admitted and notice was ordered to be issued to the OPs.
4 On receipt of the notice, the OPs appeared in the Forum through counsel, but did not file reply despite availing several opportunities. Meanwhile on 13.08.2019, ld counsel for OPs suffered a statement before the Forum that complainant Vijay Kumar has been given the credit of his renewal fees refund and credit has been given in his account. His statement was recorded before the Forum and he placed on record copy of statement of account of complainant that reflects light on the version of the OPs that credit of Rs.25,875/-has been given to complainant and now nothing is due towards him on account of cash credit limit.
5 From the above statement given by ld counsel for OPs and in the light of statement of account produced by OPs, this Forum is of considered opinion that grievance of complainant has been redressed by Ops and therefore, complaint in hand is hereby disposed off being infructuous. Copy of the order be supplied to parties free of cost. File be consigned to record room.
