Mr. M. Smith, learned counsel, for the opposite party No. 2 is present. The matter is fixed for filing evidence on affidavit in chief by the complainant side. Referring to the order dated 17-3-2023, it is submitted by Mr. Smith that in terms of the said order dated 17-3-2023 Mr. K.R. Baruah, conducting counsel, for the complainant was informed about the next date fixed as 4-5-2023 for necessary order. But as per order dated 4-5-2023 it is seen that leaving aside the other counsel, Mr. K. R. Baruah, learned counsel for the complainant was absent. As a result, last chance was given to the complainant to file evidence on affidavit in chief of the complainant side fixing today.

                        As the counsel for the complainant failed to file evidence on affidavit in chief of the complainant side, as such we dismiss this complaint for default.
