Being aggrieved by and dissatisfied with order No. 4 dt. 23.11.2021 passed by Ld. DCDRF, Kolkata, Unit-I in CC/181/2021 allowing the OPs to file W.V. The Complainant/Revisionist preferred this revision.
The Ld. Advocate for Complainant/Revisionist submitted that the Ld. Forum below accepted the W.V beyond 45 days. He also submitted that both the respondents argued that he did not receive the copy but the copy was served to the respondent and it was duly received by the office staff.
On contrary, the Ld. Advocate for the OP nos. 2 and 3 submitted that both the matter was received by the office concerned but those were not placed before the respondent concerned.
The Ld. Advocate for the respondent further submitted that the W.V filed by the OP of the complaint case was already on record before the Ld. Forum below subject to order of the State Commission in connection with the present application for revision.
The Ld. Advocate for the Revisionist further submitted that due to pandemic, office of the respondent was closed. So, they could not file the W.V in proper time.
In our view, W.V has already been filed before the Ld. Forum below and the Ld. Forum below is waiting for order of this Commission for the purpose of acceptance of the same
. Considering the facts and circumstances, we are of the view that there was not merit in the present revisional application. So, RP is dismissed. The order No. 4 dt. 23.11.2021 is upheld. The Ld. Forum below is requested to dispose of the case No. CC/181/2021 in accordance with law. Let, the copy of this order be sent to the Ld. DCDRF, Kolkata, Unit-I.
