Hazira is filed on behalf of the Complainant through Advocate.
The case is fixed for Admission hearing.
Perused the written complaint and the documents therewith.
Heard the Ld. Advocate for the Complainant.
Though the case is admissible from the view point of territorial & pecuniary jurisdiction but the Complainants have not been able to satisfy the Commission for their prima-facie case.
The Complainants have prayed for return of 70% amount as Subsidy against principle Agricultural loan of Rs.90,000/- as per Bangla Sasya Bima Yojona (BSBY) Scheme sanctioned by O.P. No.1/Bank on the ground that the cultivated paddy was totally damaged due to rainfall.

The above mentioned Agricultural loan has been sanctioned under BSBY scheme which is an Insurance Policy regulated by IRDA and one of the first and foremost condition to get the claim for any Insurance policy is to give information to the concerned Insurance Authority immediately after the loss and damage of the cultivated products and to get a Survey report for assessment of the extent of loss and damage. At the time of Admission hearing the Complainants could not furnish any of these two vital documents to establish their prima-facie claim.
Thus the Complainants have no prima-facie case to proceed against the O.P.
Hence it is ordered…..
That the case is disposed of as being not admissible for want of prima-facie case.
Both parties be supplied copy of the order free of cost.
