FINAL ORDER / JUDGEMENT
Order No.35
Dated: 25-01-2024
The Complainant files hazira through Advocate.
The case is fixed for submission of W.V. as last chance.
No step is taken by the O.P. who is found absent on repeated call. Statutory period for filing W.V. has already expired and so the Commission proceeds to dispose of the case Ex-parte in accordance with the law.
The Complainant’s case is that he opened one RIP Account with O.P./Bank No. being 1021100406444 on 08/04/2009 for Rs.16,000/- for 10 (ten) years and the matured value is Rs.22,080.38 and Re-investment Certificate was accordingly issued by the O.P./Bank vide No.413543, dated: 08/04/2019. On maturity of the aforesaid RIP the Complainant duly submitted the original RIP Certificate before the O.P./Bank for payment but the O.P./Bank refused to pay the same without assigning any reason. The Complainant has therefore approached this Commission for refund of the matured value with interest.
O.P./Bank has not come forward to contest the case by filing any Written Version despite service of Notice as per track report.
The Commission has gone through the petition of complaint particularly the RIP Certificate which shows that the Complainant is entitled to get back the matured value of Rs.22,080.38 after the maturity date on or after 08/04/2019. But the O.P./Bank has failed to discharge their duty by payment of the aforesaid amount to the Complainant in spite of production of Original Certificate and representation. The Commission finds no apparent reason for non-payment of the matured amount to the Complainant.
Prima-facie case is established. The Complainant is entitled to get the relief as prayed for.

Hence it is ordered……..
That the case is allowed Ex-parte but without cost. The O.P./Bank is directed to pay to the Complainant Rs.22,080.38 with usual interest as per Banking rule on production of original RIP Certificate if not furnished earlier to O.P./Bank within one month from this date in default the O.P. is to pay Interest @9% p.a. on the decretal amount from the date of maturity till actual payment.
Both parties be supplied copy of this Judgement free of cost.
