MA no. 353 of 2022 (for restoration)

1.     This MA has been filed on 12.04.2021 seeking recall of the order dated 17.02.2020. Vide this order, the revision petition dated 12.02.2018 had been dismissed on the grounds that despite several opportunities, the defects had not been cured and whenever the petitioner had appeared, it was only to seek an adjournment.

2.     On 17.02.2020 also none appeared for the petitioner even on the second call nor was any request for adjournment received. The revision petition was therefore, dismissed for non-prosecution since it was apparent that the petitioner had lost interest in the revision petition.

3.     When the MA was taken up today, Counsel appearing for the revisionists submitted that this MA had been filed seeking to restore the revision petition. No reasons for non-appearance of either the petitioner or his counsel have been provided. In the absence of any cogent or justifiable reasons being advanced for restoration of this revision petition, the MA no. 353 of 2022 is found to be without basis and is accordingly dismissed.
