The complainant is a doctor who had availed a post paid connection in the year 2006. On 31 March 2014, an International roaming facility of service package of Rs.786 named IR 786 Saudi Pack was activated in his mobile number. The offer was that, the complainant would be provided incoming calls at 5 rupees per minute and out going calls at 15 rupees/minute along with other facilities.
Thereafter on 2.4.14, the complainant left to Saudi Arabia. The roaming facility was used by him and the first bill was generated on 6.04.14 where in the demanded amount was Rs.2118.57 which was in excess as per the offer. As the complainant protested, the above amount was revised by opposite party as Rs.1649.79/-.
In the month of May 2014, another bill of Rs.11959/- was received by the complainant again. He again made complaint before opposite party and it was under stood that the package facility was for one particular service provider and that there existed more than one service provider in Saudi Arabia and that availment of service of various service providers would attract variable charges.
Thereafter his connection was denied. Then the complainant had issued a Rgd. lawyer notice dated 13.8.14 to the opposite party demanding to reinstate the connection bill. But it was of no avail. The acts of the opposite party caused much mental tension, loss and harassment to the complainant. Hence this complaint.
The notice issued to the opposite party was served. When the case called opposite party remains absent. Hence set exparte.
The complainant has filed Cheif Affidavit and Ext. A1 to A8 were marked. No contra evidence was adduced. Hence the case of the complainant has prooved. No contra evidence was adduced.
Hence in the interest of justice, we are passing the following orders:
(1) The opposite party shall provide the bill to the complainant according to the service package, as offered.
(2) The opposite party shall re-instate the mobile connection without any charge.
(3) The opposite party shall pay an amount of Rs.6000/- as compensation and a cost of Rs.2000/- to the complainant, failing which opposite party shall liable to pay 6% interest upon the above total amount from the date of pronouncement of this order.
This order shall be complied within one month from the date of receipt of the copy of this order.
