ORDER

Heard learned counsel for the petitioner.

 

Learned State Commission vide impugned order dated 29.5.2012 dismissed the appeal on account of non-appearance of petitioner before the learned State Commission.  The petitioner has filed this revision petition alongwith an application for condonation of delay of 55 days.  Apparently, no reason has been given in the application but as the appeal has been dismissed in default, we deem it proper to restore the appeal, subject to payment of cost of Rs.5,000/-.

Consequently, the application for condonation of delay and the revision petition are allowed and the impugned order dated 29.5.2012 passed by the learned State Commission in appeal No. 1116 of 2008-Air India vs. Bhagwan Khatri is set aside, subject to cost of Rs.5,000/- to be deposited in legal aid account of this Commission and the appeal is restored at its original number and the Learned State Commission is directed to decide the appeal in accordance with law.

The petitioner is directed to appear before the State Commission on 17.4.2013.
