This complaint is filed by the Complainant u/S 12 of the Consumer Protection Act, 1986 alleging deficiency in service as well as unfair trade practice against the OPs.
On 11.01.2018 the Complainant was present in person as well as through his Ld. Advocate. On the said date the Complainant has filed a petition supported by affidavit stating that the dispute by and between him and the OPs has already been settled amicably out of Court and for this reason he is not inclined to proceed with this complaint further and he has prayed for withdrawal of the same. According to the Complainant if this application is not allowed he will suffer irreparable loss and injury and prayer is made by the Complainant for allowing this petition.
Upon considering the fact of the petition we are of the view that as the Complainant himself is not interested to proceed with this complaint as his grievance has already been redressed by the OPs amicably out of the Court, hence we have no objection for allowing the petition filed by the Complainant supported by affidavit. Therefore the prayer of the Complainant should be allowed.
Hence it is ordered that the Consumer Complaint no-192/2017 is hereby dismissed due to on-prosecution.
Let plain copy of this order be given to the parties free of cost as per the provision of the CPR, 2005.
