1.      Case called out intermittently.  None appears for the appellant. Neither the learned counsel nor proxy counsel nor anybody else is present on her behalf.  The appeal is pending since 2020.  For a long time the file kept pending for curing the defects.  Eventually, notice was issued on 20.07.2022. 

2.       Today none appears to press the appeal.  In the afore-said circumstances it is not difficult to infer that it is a case of non-prosecution. 

The appeal hence dismissed in non-prosecution.

3.       However, in the interest of justice it may be observed that if the appellant is interested in pursuing the matter in right earnest with due diligence and feels aggrieved by this Order he may move appropriate application for recall of Order and restoration of appeal in accordance with law.      

4.       The Registry is requested to send a copy each of this Order to all parties in the appeal and to their learned counsel. The stenographer is requested to upload this Order on the website of this Commission immediately.
