          Ld. Advocate for the complainant is present.

            Petition dated 17.09.2019 filed by the complainant is taken up for hearing. Heard the Ld. Advocate for the complainant who submits that there is a some defect in the consumer complaint which cannot be removed. Accordingly, he prays for withdrawal of the complaint with a liberty to file afresh on the same cause of action.

Having heard the Ld. Advocate for the complainant and on perusal of the complaint petition, we find that there is a some technical defect in the consumer complaint which cannot be removed by way of amendment. Therefore, we are inclined to allow the prayer of the complainant.

 Hence,

Ordered

That the complainant is permitted to withdraw the consumer complaint with a liberty to sue afresh on same cause of action, if otherwise not barred by limitation.
