This record is put up today on the strength of the put up petition filed by the complainant with a prayer for dismissal of the complaint for non-prosecution.

Ld. Counsel for the complainant also files a separate verified application self-attested photocopy of Permanent Account Number (PAN) of the complainant - Subhasish Roy stating that the complainant filed this complaint against the OP for the repudiation of his insurance claim by the OP. The OP after getting the notice of the complaint contacted with the complainant and made a proposal for out of court settlement of his claim and as per the proposal of the OP, the complainant is agreed for the out of court settlement and as a result the complainant is not willing to continue with this complaint and therefore prayer is made to pass an order to dismiss the complaint for non-prosecution, otherwise legal complication will arise.

As the complainant by filing  a verified petition stating the above fact and is not willing to proceed with this complaint further as the grievance of the complainant has been settled out of this Forum, this Forum is of the opinion that the prayer of the complainant should be allowed.

Hence, it is

O r d e r e d

that the present Consumer Complaint being No. 78/2019 be and the same is disposed of on the ground of amicable settle. The case need not be put up on the date so fixed, i.e., on 05.09.2019. There is no order as to costs.

Let plain copies of this order be supplied to the parties free of cost as per provisions of law.
