Today, neither the appellant, nor respondent No. 1 have appeared, whereas learned counsel Smt. Anjali Gusain on behalf of respondent No. 2 is present.

A perusal of the record has shown that the appellant is not appearing since long time for placing arguments.

In such circumstances, the appeal is hereby dismissed in absence of the appellant.  No order as to costs.

File be consigned to the record room along with copy of this order.
