One M.A being No. 284/2017 has been filed by the O.P. No.3 praying for non maintainability of the case. The said application has been filed on 14.11.2017. On that day O.P. No.3 was directed to supply the copy of the application to all the concerned parties by fixing a further date on 08.02.2018 for hearing. On 08.02.2018 the O.P-3 was absent and therefore, a show cause order was passed against the O.P. No.3 as to why the M. A shall not be rejected. Today i.e. on 21.03.2018 the O.P. No.3, i.e. petitioner of the M.A, is absent without any steps. No show cause filed by him as per the previous order. Due to absence of the O.P. No.3 the hearing could not be done and due to non filing of show cause the said petition is rejected.
Hence, M.A. No. 284/2017 is hereby rejected.
It is seen from the case record that the O.P. Nos. 2 and 4 received the notice on 19.04.2017 and 25.04.2017 respectively but they did not appear despite receipt of the notice. Hence, the case shall run ex parte against them.
To 18.07.2018 for E. Chief by the complainant.
Let a plain copy of the order be supplied to the parties free of cost as per CPR, 2005.
