Final Order / Judgement

Per Mr B A Shaikh, Hon’ble Presiding Member

None is present for the appellant. Perusal of the record & proceedings of the appeal shows that the appeal was filed on 28.04.2011. The Registrar of this Commission recorded office objections on 17.01.2018.

The appellant has not removed those office objections till this date.  Therefore, as per direction of this Commission dtd.16.02.2018 notice dtd.21.02.2018 was issued to the appellant calling upon him to remove those office objections within 15 days of receipt of that notice.  He was also warned in that notice that if he fails to remove those objections within given time, then appeal will be placed before Circuit Bench for appropriate order.

The said notice was duly received by the appellant as seen from the acknowledgement received about the same. However, despite service of notice also, the appellant did not appear and failed to remove office objections. Hence, the appeal is placed before thus bench for appropriate order.

We find that as the appellant failed to appear since long and as he also failed to remove office objections since long despite service of notice, the appeal deserves to be dismissed in default.

In the result, the appeal is dismissed in default.
