The complaint here arises from tour travel undertaken by the complainant between 21.5.2012 to 1.6.2012 for the alleged inadequacies in their arrangement and resultant deficiency in service on the part of the respondent-M/s Yatra Online and compensation of Rs. 5 lakh has been claimed in the complaint.

          After arguing the matter for some time, learned counsel for the complainant seeks to withdraw the consumer complaint with liberty to file it with the appropriate forum.

          The oral submission is accepted and the consumer complaint No. 82 of 2014 is dismissed as withdrawn.  It is also observed that the complainant is permitted to file the suitably modified complaint before the appropriate forum within a period of four weeks from the date of this order.  We trust that the concerned forum will consider the resultant delay, if any, in the light of the observation of Hon’ble Supreme Court in the case of Laxmi Engineering Works vs. P.S.G. Industrial Institute (1995) 3 SCC 583.
