  This is a case remitted by the State Consumer Disputes Redressal Commission, Kerala as per order in Appeal No.518/99 dtd.25/4/2000 to give an opportunity to the opposite party M/s Voltas Limited, Share Service Centre to produce the copy of the order of the Bombay Civil Court and also to  prove that the  subject matter of the complaint is also taken by the order of the civil court.  Accordingly, the matter is restored back and notice was issued to opposite party.  Eventhough, notice is served  and a counsel is proposed appearance for  opposite party later in spite of granting repeated chances for the production of the order of civil court nobody turned up.  Hence the complainant adduced evidence  by way of affidavit.  The transfer application form marked as Ext.A1-.

 

    This  is a case alleging deficiency in service on the part of opposite party due to the non transfer of the share  certificates purchased by the complainant.  The opposite party remained absent and no evidence either oral or documentary adduced.  The order of Bombay Civil Court also not produced to substantiate their  contention and to convert the evidence let in by the complainant.  In the circumstances, we allow the  complaint and the opposite party is directed to do transfer the share certificate in the name of the complainant and her husband and also to pay Rs.2000/- towards compensation with a cost of Rs.2000/-.  Time for compliance  30 days from the date of receipt of copy of order.
