PRESENT:

Sh.Harsh Nagra, Counsel for Complainant.

Sh.Mayur Kanwar, Counsel for OP No.1.

Sh.Gaurav Bhardwaj, Counsel for OP No.2.

Dated : 30th May 2019

ORDER

1.        Counsel for complainant pleads no instructions on behalf of complainant. He has placed on record a notice dated 29.04.2019 issued to the complainant vide which counsel for complainant conveyed that further instructions may be given to him for appearance before this Forum. Contents of the notice further shows that counsel had many times tried to contact the complainant to seek further instructions either to continue with the complaint or to withdraw the same. However, complainant has not responded. It was sent through registered post on 30.04.2019. Postal receipt placed on record with notice. Perusal of the complaint shows that complainant is in the habit of not putting in appearance before this Forum. It seems that he likes to put in appearance before this Forum as per his convenience and wishes. From 08.06.2018, the matter was posed on 16.07.2018, but complainant was not present. Again on 16.07.2018, the complainant was not present. Further on 20.11.2018, the complainant was not present. Again on 08.01.2019, the complainant was not present and further on 05.04.2019, the complainant was not present. It is only the counsel Sh.Harsh Nagra, Advocate, who had put in appearance on other dates i.e. 25.02.2019, 26.09.2018, 24.08.2018 and 24.04.2018. In view of the repeated non appearance of the complainant and further non imparting of instructions to his counsel despite of the fact that he was duly intimated through registered notice, we are convinced that complainant is not interested to continue with this present consumer complaint. Hence, this consumer complaint is dismissed for want of prosecution and non appearance of the complainant.

2.        Certified copies of this order be sent to the parties free of cost. The file be consigned
