ORDER:                    

 

                        This complaint has been filed by the complainant u/s 12 of the Consumer Protection Act 1986 on the averments that complainant wants to port his mobile numbers 9416524422, 9467044420, 9254261114 and 8295700542 from Airtel to Vodafone. Due to bad service of Vodafone his number 9467044420 activated after one day from closing of service from Airtel after visiting to Vodafone store. Another number 9416524422 were also not functional and complainant visited the store of the OPs to get it activated. Mobile number 8295700542 is still not activated by Vodafone after 12 days of closing of service from Airtel. Due to this poor service of Vodafone the complainant suffered a lot. His son user of mobile no.9467044420 came from Mohali just to replace the SIM they provided earlier. Similarly, myself user of mobile no.9416524422 visited several times to store just to rectify their errors so that his number get functional. Moreover, mobile no.8295700542 of sales person of complainant Mr. Amit is still not working from last 12 days. Due to this negligence act of the OP complainant suffered loss in sale business and mental harassment. Hence complainant filed the present complaint.

2.             Notice of the complaint was given to the OP, who did not appear and proceeded against exparte, vide order dated 13.08.2019.

3.             Complainant tendered into evidence affidavit Ex.C1 and documents Ex.C2 to Ex.C7 and closed the evidence on 16.08.2019.

4.             We have heard the complainant and have gone through the record available on the file.

5.             As per allegations of the complainant, he wants to port his mobile numbers 9416524422, 9467044420, 9254261114 and 8295700542 from Airtel to Vodafone. Due to bad service of Vodafone his number 9467044420 activated after one day from closing of service from Airtel after visiting to Vodafone store. Another number 9416524422 were also not functional and complainant visited the store of the OP to get it activated. Mobile number 8295700542 is still not activated by Vodafone after 12 days of closing of service from Airtel. Due to this poor service of Vodafone the complainant suffered a lot. In support of his version complainant filed his affidavit Ex.C1 and documents Ex.C2 to Ex.C7. To rebut the evidence produced by the complainant OP did not appear and opted to be proceeded against exparte. So, the evidence produced by the complainant is unchallenged and unrebutted and there is no reason to disbelieve the same. Hence it is well proved that the service of the OP is deficient.

6.             Thus, as a sequel to abovesaid discussion, we allow the present complaint and direct the OP to activate the mobile numbers of the complainant mentioned in the complaint and further direct the OP to pay Rs.7000/- to the complainant as compensation for harassment, mental agony and for litigation expenses. This order shall be complied within 30 days from the receipt of copy of this order. The parties concerned be communicated of the order accordingly and the file be consigned to the record room after due compliance.
