Heard Complainants counsel at length.  Relief prayed by Complainant is to provide proper network at residence of Complainant. Learned advocate for Complainant has argued that it has been one year since he has raised a grievance with O.P., but they have still not rectified the problem. From annexures it can be seen that O.P. has written to Complainants society seeking permission to install mobile tower, which Complainant has himself informed to O.P. that has been denied due to fear of radiation (Ex.E Pg.36).   Further at Ex.G, Pg.44, O.P. has  also informed Complainant that there is technical infeasibility to install booster at his location however OP have assured they will take steps for implementation subject to approvals from concerned authorities/society.

Under the circumstances, we come to conclusion that OP is unable to provide network at the present time, due to parameters beyond their control which they have assured Complainant of resolving in due course.

Installation of mobile towers would be a time taking process, therefore we concur with the reply given by OP to the present problem. Accordingly complaint is dismissed in limine.
