          The facts in issue are that the complainant is subscriber of Mobile No.9888916869 of OP Company for the last so many year, but on 2.9.2017, the outgoing services on the said mobile number has abruptly discontinued/stopped by the OP without intimation.  It is averred that on enquiry, it revealed that outgoing calls have been stopped due to pending bill of other mobile connection issued in the name of complainant but used by some other family member.  It is also averred that the complainant never got any intimation about the said pending bill payment from the OP either on his number or other number provided by OP. It is further averred that the being helpless, got the amount deposited, but even then the services were not restored by the OP and it only when the complainant called them several times, then the outgoing services were restored after approx. 48 hours.  It is submitted that after restoration of service, the complainant received the message from OP intimating her about the payment of pending bill of other mobile number, whereas it should have been done earlier by the OP, which they did not do.  It is also submitted that the complainant is practicing Advocate and due to said deficient act of the OP, she had to suffer a lot. Hence, this complaint has been filed.

 

2]       OP did not turn up despite service of notice sent through regd. post on 12.9.2017, hence it was proceeded exparte vide order dated 17.10.2017.

 

3]       Complainant led evidence in support of her evidence.

 

4]       We have heard the ld.Counsel for the complainant and have also perused the entire record carefully.

 

5]       The complainant admittedly have two telephone connections from the OP Company, in one Account id34591101, in her name.  It is also admitted by the complainant herself that the bill amount of her other telephone connection, which was used by the her other family members, was due for payment. 

 

6]       The Telecom Companies always send messages/reminders for payment of billed/outstanding amount. In the present matter, the complainant must have received message from the OP regarding payment of her outstanding bill on that other number.  It does not matter if the other telephone connection is being used by some other family member of the complainant in the house.  It is the prime responsibility of the account holder itself to clear the bill in time to avoid uninterrupted services from the telecom company/service provider. The outgoing services of other phone connection of the complainant has been temporarily stopped for want of pending bill, which seems to be valid and justified.  Moreover, admittedly the OP has restored the services on the alleged telephone number of the complainant on receipt of the bill amount, hence no prejudice has been caused to the complainant. The complainant cannot take benefit of her own lapses and laches.   

 

7]       Keeping in view the above facts & circumstances of the case, the present complaint is found to be without merit and hence dismissed.  No order as to costs.

         The certified copy of this order be sent to the parties free of charge, after which the file be consigned.
