Heard ld. lawyer of complainant and perused the documents on record. The bills were issued by o.p. in the name of complainant no.1 and complainant no.2 has contacted with o.p. for their grievance. Here complainant no.1 is M/s B.S. Hardware Stores. Complainant has stated in para 2 of the complaint petition that complainant no.2 is the sole proprietor of complainant no.1 and complainant no.3 is the husband of complainant no.2. Complainant no.1 is running its business. So, it is assumed that the phone is being used by complainant no.1 for commercial purpose. So, we find and hold that complainants cannot be termed as consumer within the scope and ambit of C.P. Act, 1986. As such, the instant complaint is rejected with a liberty to the complainants to agitate the issue on the self same cause of action before the appropriate Forum.
