Facts in brief

The complainant is having a postpaid connection under opposite parties for more than one year. By the attractive words of one of the executives of the opposite parties he had taken an unlimited internet pack for an amount of Rs.299/-. Thereafter he had received a bill for an amount of Rs.450/- during the period of May 22 to June 21. The acceptance of the excess bill was informed to opposite parties and they had reduced the over bill and the complainant had paid Rs.1500/- towards opposite parties.

On 1.8.15 the complainant informed all these matter to Mr. Sajan Samuel and requested him to reduce the over bill. Thereafter two weeks the opposite parties had barred the internet, message and out going facility of the complainant.

 

The complainant is a clinical psychologist and the barring of outgoing calls and other facilities created much hardships and difficulties to the complainant. Now he is not in a position to contact with his patients, friends and relatives. Hence this complaint.

 

Emergent Notice was issued to the opposite parties and when the case called, opposite party remain absent. No representation and hence set- exparte.

 

Heard the complainant. Complainant filed chief Affidavit. No oral evidence adduced. No documents also produced.

 

The complainant is a doctor by profession and the barring of the facilities including outgoing, messages etc will affect his profession. So considering the above situation, we are passing the following orders.

 

1. The opposite parties shall jointly and severally liable to re-instate the connection with all existing facilities including internet, out going and messages within 10 days of the receipt of the copy of this order.

 

2. The opposite parties shall not receive any additional amount from the complainant for complying the above order..

3. Both opposite parties shall jointly and severally liable to pay a compensation of Rs.10,000/- and a cost of Rs.1000/- to the complainant, failing which opposite parties shall further pay 6% interest upon the above amount from the date of pronouncement of this order.

 

The 3rd order shall be complied within one month from the date of receipt of the copy of this order.
