ORDER

Service qua respondent No.1/complainant is complete.

2.                Sh. Devinder Kumar, Advocate has put in appearance on behalf of respondent No.1/complainant by filing his memorandum of appearance, which is taken on record.

3.                Alongwith the appeal, an application for condonation of delay of 100 days as per the applicant/appellant  (as per the office report 76 days), in filing the appeal, has been filed.

4.                Counsel for  respondent No.1/complainant states that he has no objection, in case, the delay aforesaid is condoned.

5.                Accordingly, the delay in filing the appeal stands condoned.

6.                The application is disposed of accordingly.

7.                This appeal has been filed by the appellant/Opposite Party No.2 (One Assist Consumer Solutions Pvt. Ltd.) against order dated 09.01.2018 passed by District Consumer Disputes Redressal Forum-II, UT, Chandigarh (in short “the Forum” only), vide which, the aforesaid appellant was ordered to be proceeded against exparte.

8.                At the time of arguments, Sh. Devinder Kumar, Advocate, Counsel for respondent No.1/complainant has taken a very fair stand that let the exparte proceedings against the appellant/Opposite Party No.2 be set aside and the matter be heard on merits.

9.                We appreciate the concession given by Counsel for respondent No.1/complainant.

10.              In view of above, this appeal is allowed. Order, under challenge, is set aside qua the appellant/Opposite Party No.2.

11.              Parties are directed to appear before the Forum today itself.

12.              Order passed is subject to payment of Rs.5,000/- as cost. Let amount of cost be paid by the Counsel for the appellant/Opposite Party No.2 to respondent No.1/complainant on the next date of hearing to be fixed by the Forum.

13.              Certified copies of this order be given dasti to Counsel for both the parties.

14.              Complete original record of the Forum is sent back to the concerned Forum.

15.              Certified copy of this order be sent to the concerned Forum, immediately, so as to reach there before the date fixed.

16.              File be consigned to the Record Room after completion.
