At the outset, learned Counsel appearing for the Appellants submits that during the pendency of this Appeal, an amicable settlement has been arrived at between the parties before the Executing Court. 

The Complainant/Decree Holder is represented by his Counsel, who, while admitting that there has been an amicable settlement between the parties, states that some of the instalments, in terms of the said settlement, are yet to be received by the Complainant.

In view of the above, we dispose of the Appeal, with an observation that if the terms of settlement are not adhered to by the Appellants, it will be open to the Complainant to take appropriate steps for enforcement of the terms of the said settlement.   

The Appeal stands disposed of in the above terms.
