O R D E R

This is an appeal filed by OP in C.C.No. 1144/2016 on the file of I Additional District Consumer Disputes Redressal Forum, Bangalore aggrieved by the order dated 26.05.2018.

  1. We examined the impugned order passed in C.C.No.1144/2016 dated 26.05.2018 by forum below.  The complainant/respondent herein raised consumer complaint and sought relief against OP/appellant for refund of Rs.14,38,000/- along with interest at the rate of 12% p.a. and Rs.5.00 lakhs as damages towards harassment and mental agony.  It has come in the enquiry that OP/appellant have duped Rs.14,38,000/- and they failed to return such amount.  The forum below received evidence of CW-1 and RW-1, document Nos. 1 to 13 produced on behalf of complainant and document Nos. 1 to 5 produced on behalf of OP/appellant herein.  Thereby found that complainant/respondent herein has only paid Rs.1,62,000/-.  Accordingly, held he is not entitled for Rs.14,38,000/- as claimed and directed OP to pay a sum of Rs.1,62,000/- along with interest at the rate of 12% p.a. from 27.06.2016 and awarded Rs.10,000/- towards damages and Rs.5,000/- towards costs of litigation, which does not call for any interference of the Commission in appeal for the grounds set out in the appeal memo.  Accordingly, proceed to dismiss the appeal with no order as to costs and direct the office to transfer Rs.25,000/- to the forum below for needful.
