            Adv. Mr. Vora is present for the  appellant.  None is present for the respondent Nos. 1&2 though Adv. Mrs. Shirbhate had appeared on 17/06/2014 for them and filed  written notes of argument.  It is brought to our notice by the Adv. Mr. Vora that  two appeals  i.e. present appeal and another appeal No. A/05/1132 have been inadvertently  filed by the same appellant against the same impugned order.  He also submitted that  the  another appeal No. A/05/1132 is also listed today for final hearing. He therefore requested that the proceeding of the present appeal No. A/05/1094 may be closed  and  another appeal No. A/05/1132 may  be continued.  After perusal of the record and proceeding of present appeal  and  that of another appeal bearing No. A/05/1132 we find substance in the aforesaid  submission of Adv. Mr. Vora..  We find that  the present appeal  cannot be continued  with another appeal No. A/05/1132 is already proceeded with. Therefore the proceeding of the present appeal  are closed.  This appeal is merged with appeal No. A/05/1132. Adv.Mr. Vora shall  give intimation in writing to Adv. Mrs. Shirbhate and respondent Nos. 1&2 about merging  of the present appeal with appeal No. A/05/1132 and shall produce the intimation letter with acknowledgement  on next date in appeal No. A/05/1132.
