       The case of the complainant in short is that complainant purchased an Usha ceiling fan from Bengal Camp, CSD Canteen, Bengal Area H.Q. Kolkata-27 on 12.3.13.

            Complainant stated that the said fan started some problem immediately after receiving the same by complainant and accordingly complainant intimated the same to the concerned authority. Complainant stated that in spite of issuance of letter dt.16.3.13  o.p. did not take any step towards redressal of the said fan.

            Complainant stated that after a great deal of botheration he filed the instant case before this Forum with the prayers contained in the prayer portion of the petition of complaint.

            O.ps. appeared before this Forum by filing w/v and contested the case. In their w/v o.ps. stated that upon receiving complaint by complainant they replaced the same twice in good condition. O.ps. stated that during pendency of the case i.e. on 5.2.14 they have once again replaced the ceiling fan and which has been accepted by a representative of complainant on the same date without any protest knowing fully well that the instant case is proceeding before this forum in respect of the dispute of the ceiling fan in question.

O.ps. stated that complainant filed the instant case which is absolutely false and fabricated and prayed for dismissal of the case.

Decision with reasons:

            Upon considering the submissions of the parties and on careful scrutiny of the entire materials on record this Forum holds that o.ps. had not made any deficiency of service towards the complainant since they had replaced the fan in question upon receiving complaint by complainant and complainant is not entitled to relief.

            Hence, ordered,

            That the case is dismissed on contest without cost against the o.ps.       

            Supply certified copy of this order to the parties free of cost.
