This miscellaneous case has been filed for restoring FA No. 14/2012 dismissed for non-prosecution on 18.2.14.

It is submitted that on 18.2.14 when this case was dismissed for non-prosecution, learned Counsel for the appellant was on legs before D.R.T. Ranchi and therefore he could not appear before this Forum.

In FA/14/12 notice was issued on the point of limitation and admission on 09.02.12. The appellant was directed to file requisites. Thereafter no steps were taken. The case was posted on Sixteen dates, but neither anybody appeared for the appellants nor any steps were taken. Accordingly, this appeal was dismissed for non-prosecution, on 18.02.2014.

There is no explanation whatsoever, why steps were not taken for about two years.

In our opinion, no grounds are made out for restoration of the said F.A. No. 14/2012. Accordingly, this Misc. case is dismissed.
