ORDER (ORAL)

          Heard learned Counsel for the Petitioner in brief.

          The Appeal filed by the Petitioner/Appellant/Complainant before the State Commission was dismissed for non-prosecution of the learned Counsel for the Appellant on 06.06.2024.  He states that it was the only occasion on which the counsel could not be present due to certain personal reasons and unfortunately, the learned State Commission decided to dismiss the Appeal itself for non-appearance.  He also states

that the Appellant/Petitioner is a poor farmer and he seeks that the matter be remitted back to the State Commission for consideration on merits which as per him has a good case.

After hearing learned Counsel for the Petitioner and perusal of the records, we consider it appropriate to remit the matter back to the State Commission while setting aside the orders of the State Commission and restore the Appeal to its original number, subject to the Petitioner depositing costs of ₹2,000/ in the Consumer Legal Aid Account of the State Commission within a period of four weeks.  Subject thereto, the orders of the State Commission dated 06.06.2024 & 11.07.2024 in Appeal No.520/2021 & RA/70/2024 are set aside and the Appeal No.520/2021 is restored to its original number.    

All the parties are directed to appear before the State Commission on 23.01.2025. 

On that date, Petitioner is directed to produce the proof of deposit before the State Commission.

          The learned State Commission is requested to consider the matter as per law preferably within a period of four months.

          With these directions, Revision Petition No.2903 of 2024 stands disposed of.

          All pending applications, if any, are also disposed of accordingly.
