CONSUMER COMPLAINT NO. 250  OF  2019

Sh.Sukaam Gupta, Counsel for Opposite Party(OP).

ORDER

1.        Heard. The matter has amicably been settled between the parties. Counsel for OP has handed over a cheque bearing No.996647 dated 14.10.2019 in the sum of Rs.4,04,000/- to the complainant in his favour in full and final settlement in this consumer complaint. Photocopy of cheque alongwith receipt retained on record. Statement of complainant alongwith his counsel and that of counsel for OP have been recorded separately and placed on file along with one document Ex.CA, in view of which the present consumer complaint is disposed of being settled. Statement of the parties recorded today shall form a part of this order and shall be binding on both the parties.   

2.        Lok Adalat on its own motion makes it clear that in case the aforesaid cheque is bounced, OP shall make the payment of Rs.4,04,000/- to the complainant along with interest @ 9% p.a. from today i.e. 17.10.2019 till the payment is made and this order shall be treated as executable decree and the complainant shall be at liberty to get the same executed by filing execution and for the bounced cheque, OP shall also pay Rs.10,000/- as penalty to the complainant.

3.        Certified copy of this order be sent to the parties free of cost. The file be consigned.
