No one appears on behalf of opposite party No.3 in spite of service of notice. Learned counsel for the complainant submits that after filing of this complaint, its claim which had been filed with the opposite party Company and was under process, has since been repudiated by opposite party Company vide its letter dated 22.7.2013. In view of this development, learned counsel submits that the repudiation of the claim will also have to be challenged and as such he prays for permission to withdraw this complaint with liberty to file a fresh complaint in the matter. In view of the request made, the complaint and IA No.2228/2013 are dismissed as withdrawn with the liberty prayed for.
