          Notice of today’s hearing was issued to the counsel for the appellant on 30.10.2009.  30 days from the issuance of the Notice are already over.  Present none.

          Counsel for the appellant has also not supplied the fresh address of Respondent No.2 in spite of several opportunities given to him.  Dismissed for non-prosecution.

          Even on merits, we find that there was no concluded contract between the parties till the date of filing of the complaint.  Respondent had not sanctioned the loan.  Dismissed.
