Today is fixed for admission hearing of this complaint. At the time of admission hearing it is noticed by us that the petition of complaint filed by the Complainant is not supported by affidavit. In view of the landmark judgment of the Hon’ble Supreme Court passed in the case of Dr. J.J. Merchant vs. Srinath Chaturvedi filing of the petition of complaint should be supported by affidavit. As at the time of filing this complaint the said direction has not been followed by the Complainant, hence we are not in a position either to take this complaint for admission hearing or to admit the same. Hence the complaint filed by the Complainant is hereby dismissed due to non-observing the settled practice and procedure of filing the complaint. However the Complainant is at liberty to file the complaint in a proper manner after observing the settled procedure.

Going by the foregoing discussion hence it is order that the complaint being no-413/2017 is hereby dismissed without being admitted.  

Let plain copy of this order be given to the party free of cost as per the provision of the CPR, 2005.
