ORDER

                    At the time of arguments, it was brought to our notice by the Counsel for the Opposite Parties that the unit, in question, was sold against a Tripartite Agreement. Alice Developers Pvt. Ltd. was one of the signatories to the said Agreement. The said party was also responsible to develop the project in terms of the Buyer’s Agreement. The said party has not been impleaded in the present complaint.

                   Faced with this situation, Counsel for the complainant wishes to withdraw the complaint with liberty to file it again after impleading the above said party as one of the Opposite Parties.

                   Liberty granted.

                   The time consumed in prosecuting this complaint before this Commission shall not be added to the period of limitation, for filing the complaint a-fresh.

                   Accordingly, the complaint is dismissed as withdrawn.

                   Certified copies of the order be sent to the parties free of charge.
